My Home Mortgage Foreclosure Remedy Practice

I provide comprehensive counsel to people facing foreclosure actions, helping them protect their rights throughout the process and working with them to identify foreclosure alternatives. I can act as your advocate in all hearings and proceedings, providing you with the knowledgeable, aggressive representation you deserve.

I will also make certain that your lender follows all rules and procedures required by law to complete the home mortgage foreclosure. Where applicable, I will raise Truth in Lending, Fair Credit Reporting Act and Home Ownership Equity Protection Act defenses or claims that you may have, as well as any claims involving fraud, false advertising or unfair/predatory lending practices.

Other defenses that can be raised in a foreclosure proceeding include:

  • Breach of contract, promise or guarantee by the lender
  • Prior knowledge of the lender that you would not be able to pay
  • Improper sale of your loan to a third party

If we determine that you don't have strong defenses to the home mortgage foreclosure action, I will explore foreclosure alternatives with you, including the short sale of your property and the negotiation of home loan modifications. In a short sale, I will attempt to get your lender to agree to sell the property for the balance due on your note, so that you will have no further obligation on the mortgage. I can also work with your lender to try to negotiate a change in the interest rate or a modification of other terms of your mortgage loan, so that you can afford to make payments.
